目的 分析医疗损害案件中的精神损害赔偿的相关因素，构建医疗损害中精神损害赔偿模型。方法 以
2 224例医疗损害纠纷案件为研究对象，构建线性回归模型。结果 地区、医院等级、损害结局、医院责任这4个因素对医疗损害纠纷精神损害赔偿金额有影响，将4个有效因素纳入线性回归模型，构建医疗损害中精神损害赔偿模型。结论 医疗损害中精神损害赔偿模型计算简明，可以为医患双方提供精神损害赔偿的数额参考，避免患方索赔的盲目性，合理维护医患双方权益，提高医疗纠纷的解决率，保障法律的可预期性。 |

Objective
To analyze the related factors of metal compensation of medical damage disputes and construct mental compensation model for medical damage disputes. Methods Using Linear regression analysis method to construct mental compensation model of 2 224 medical damage disputes. Results Region，hospital grade，damage result and hospital responsibility play an important role in metal compensation of medical damage disputes，so these four factors are used to construct mental compensation model. Conclusion Mental compensation model of medical damage disputes is convenience to calculate. It can provide the amount of compensation for mental damage for both hospital and patients，and it also can protect the right of hospital and patients. Furthermore，the model will improve the resolution rate of medical disputes and protect the predictability of the law. |
