随着公立医院与社会资本联姻模式的推广，公立医院特许经营机制也逐渐应用推广。然而由于我国现有法律机制的阙如，特许经营模式欠成熟，加之公立医院自身现存的体制性弊病，导致公立医院特许经营步履蹒跚。通过厘清公立医院特许经营的基本概念和运营模式，分析公立医院特许经营过程中存在的典型政策困境，寻找当前公立医院特许经营的合法和合理性依据，提出应对公立医院特许经营风险的具体策略，为推动公立医院改革提供借鉴。 |

| With the promotion of Marriage between public hospitals and social capital, franchise mechanism in public hospitals has been gradually applied. However, due to the lacking of legal mechanisms, less mature franchise model, coupled with the existing public hospitals’ own institutional shortcomings, all this leading to public hospitals franchise has been slowed. Through clarifying the basic concepts and operating models, typical legal risks existing in the process of public hospitals franchise is analyzed, the current legal and rational basis of public hospitals franchise are found, specific strategies to deal with the public hospital franchise legal risks are proposed to promote the reform of public hospitals. |
