| 基于法经济学视角，构建了医疗损害成本函数经济模型，并以此为工具确定了医师防御性医疗行为的界定标准，分析和推导出影响医师防御性医疗行为的关键因素包括在确定医疗损害责任时的信息不完善，医师承担大量的非财务成本损失，医疗损害赔偿的交易成本不为零，医师是风险规避型，医师不承担预防医疗损害的成本。 |

| Economic model of medical injury cost function is constructed from the perspective of law economics to identify evaluation criterion for DM. Key influence factors of DM include imperfect information in identification of the responsibility of medical malpractice，huge non-financial costs of physicians，transaction costs of compensation of medical damages，risk-averse attitude of the physicians，zero-cost of prevention for medical malpractice for physicians. |
